Presentence Investigations: The Adult Investigations Unit prepares adult presentence investigative reports and other documents for all felonies and some misdemeanor cases following a conviction. The probation officer’s primary goal is to provide an accurate and thorough investigation for the Court to determine an appropriate sentence. These reports include the circumstances of the offense, terms of plea, background of the defendant, victim statements, aggravating and mitigating circumstances and a discussion on the recommendation to assist the court in a sentencing decision. The focus on the report is the protection of the community, rehabilitation to offenders and compensation to victims. This unit also provides Prop 63 reports pursuant to Penal Code Section 29810. Upon conviction of a felony and certain misdemeanor offenses, the Court provides the defendant with a Prohibited Persons Relinquishment Form at the time of conviction advising the defendant to comply with the law. The Court also assigns the matter to the Probation Department to investigate whether or not the defendant owns, possesses, or has under his or her custody or control of any firearms. Pretrial Supervision: In April 2021, the Probation Department implemented a pretrial release program. The department utilizes a validated pretrial assessment tool that assists officer’s to determine whether individual’s should be released or remain detained pending their court proceedings. A bail report is submitted to the Court at the time of arraignment and include the individual’s criminal history, ties to the community, financial means to make bail and risk to the community and victim(s). The benefits of the program are to help reduce jail overcrowding and enhance opportunities for low risk offenders to maintain in the community. The individuals are monitored throughout their court hearings until they enter a plea or the case is dismissed. This unit also provides officers to the Court who are present during hearings to assist the Court, District Attorney and Public Defender in resolving probation related issues. 1203.4 CPC Dismissals: 1203.4 PC reports are written for the Court when an offender has fulfilled the conditions of probation and upon completion of probation, can request for dismissal of the case and the conviction be vacated.
